1. Acceptance of Terms

By accessing or using PriceCheck (www.pricecheck.co.in), operated by SHALIN & SYON AHIR PRIVATE LIMITED (registered at 19 Gautam Park, Anklesvar, Bharuch, Gujarat, India — 393001) ("Company," "we," "our"), you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Platform.

These Terms constitute a legally binding agreement between you and the Company, governed by the laws of India, including the Information Technology Act, 2000, Consumer Protection Act, 2019, and Indian Contract Act, 1872.

2. Description of Services

PriceCheck is a price comparison platform that:

• Aggregates product prices from various e-commerce platforms in India
• Compares prices across 15+ platforms including Amazon, Flipkart, and others
• Provides users with the lowest available price upon payment of a service fee (₹29)

We are an independent price comparison service. We do NOT sell products, process orders, or have any commercial relationship with the e-commerce platforms listed.

3. Service Fee and Payment

3.1 Fee Structure

• Price reveal fee: ₹29 (including GST) per search
• Payment is required BEFORE prices are revealed
• Payment is processed securely via Razorpay UPI

3.2 What You Receive

• Complete price comparison across all available platforms
• Direct links to purchase from the lowest-price platform
• Price information valid at the time of search

3.3 Payment Terms

All payments are final and non-refundable except as specified in our Refund Policy. By making a payment, you acknowledge that you have read and understood these Terms.

4. Referral Program

• Users earn 1 FREE price reveal for every 5 successful referrals
• A "successful referral" means the referred user completes at least one paid price reveal
• Referral rewards are non-transferable and have no cash value
• We reserve the right to modify or terminate the referral program at any time
• Fraudulent referral activity will result in account termination and forfeiture of rewards

5. User Responsibilities

You agree to:

• Provide accurate information when using our services
• Use the Platform only for personal, non-commercial purposes
• Not attempt to circumvent, disable, or interfere with security features
• Not use automated systems (bots, scrapers) to access the Platform
• Not engage in any activity that disrupts or interferes with our services

You agree NOT to:

• Resell or commercially exploit our price comparison data
• Create multiple accounts to abuse the referral program
• Use VPNs or proxies to manipulate location-based features
• Attempt to reverse engineer or copy our technology

6. Disclaimer of Warranties

• Our service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We do NOT guarantee that prices shown are always the lowest available
• Prices may change between the time of search and actual purchase
• We are NOT responsible for product quality, delivery, or seller behavior
• We do NOT guarantee availability of products on third-party platforms
• Technical errors or data inaccuracies may occasionally occur

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW:

• Our total liability for any claim shall not exceed the amount paid by you (₹29 per transaction)
• We are NOT liable for any indirect, incidental, special, or consequential damages
• We are NOT liable for any loss arising from your transactions with third-party sellers
• We are NOT liable for any data loss, business interruption, or lost profits

This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise).

8. Indemnification

You agree to indemnify, defend, and hold harmless PriceCheck, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

9. Intellectual Property

• The PriceCheck name, logo, and branding are our trademarks
• All content, design, and technology on the Platform are our intellectual property
• You may not copy, reproduce, or distribute our content without written permission
• Third-party trademarks (Amazon, Flipkart, etc.) belong to their respective owners

10. Account Termination

We reserve the right to:

• Suspend or terminate your access for violation of these Terms
• Refuse service to anyone at our sole discretion
• Modify or discontinue the service at any time without notice

Upon termination, your right to use the Platform ceases immediately. Unused referral rewards will be forfeited.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes shall be subject to the exclusive jurisdiction of courts in [City], India.

11.3 Arbitration

Before initiating legal proceedings, parties agree to attempt resolution through arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, with a single arbitrator mutually agreed upon by both parties.

12. Modifications to Terms

We may modify these Terms at any time by posting the revised version on the Platform. Changes take effect immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and PriceCheck regarding your use of the Platform, superseding any prior agreements.
